California Judge Yvonne Gonzales Rogers has denied Epic Games’ request for a preliminary injunction that would have forced Apple to bring back Fortnite to its App Store. It wasn’t a complete defeat for Epic as Judge Gonzales decided Apple should not act against Epic Games’ Unreal Engine.
The decision by Gonzales is effective immediately “and will remain in force until the disposition of this case.”
Apple had decided to take the popular battle royale game off the App Store due to the direct-pay option Epic Games enabled to skip Apple’s 30% tax for in-game purchases.
“Epic Games is grateful that Apple will continue to be barred from retaliating against Unreal Engine and our game development customers as the litigation continues,” said an Epic Games spokesman. “We will continue to develop for iOS and Mac under the court’s protection and we will pursue all avenues to end Apple’s anti-competitive behavior.”
“We’re grateful the court recognized that Epic’s actions were not in the best interests of its own customers and that any problems they may have encountered were of their own making when they breached their agreement,” said Apple.
